These terms cover your use of evrgreendigital.com and Evrgreen's text messaging programs, operated by EVRGREEN ("Evrgreen," "we," "us"). By using this site or opting in to our messages, you agree to them. The rules for our text messages are in the SMS Terms section.

What this site is

This site describes Evrgreen's services and lets you get in touch about them. Nothing on this site is a binding offer or contract. Actual services, pricing, and deliverables are agreed separately, in writing, before any work begins. If a written service agreement conflicts with these terms, the service agreement controls.

Acceptable use

Please use this site for its intended purpose: learning about Evrgreen and reaching out about our services. You agree not to:

• Attempt to disrupt, overload, or gain unauthorized access to the site or its systems
• Scrape or copy the site at scale, or use automated tools to submit the intake form
• Submit false, misleading, or malicious information, or someone else's contact details without their permission
• Use the site in any way that violates applicable law

SMS Terms

EVRGREEN operates the two text messaging programs below. These terms apply only to messages sent by Evrgreen.

1. Evrgreen Inquiry Updates

• Who receives it: people who contact Evrgreen through this website and choose to provide a mobile number.
• What we send: replies and follow-up about the inquiry you submitted, such as answering your questions or scheduling a call.
• How you opt in: by entering your mobile number in the contact form on evrgreendigital.com and checking the consent box, which is optional and unchecked by default. The consent box reads:

• Example message: "Evrgreen: Hi Sam, thanks for reaching out about missed after-hours inquiries. Are you free for a 15-minute call Thursday? Reply STOP to opt out."

2. Evrgreen Lead Alerts

• Who receives it: owners and staff of businesses that are Evrgreen clients.
• What we send: a notification each time the client's lead capture system captures a new lead, with a short summary so the right person can follow up.
• How you opt in: the client designates each mobile number that should receive alerts, with each recipient's consent, in their written service agreement or onboarding form with Evrgreen. Alerts are never sent to numbers that weren't designated this way.
• Example message: "Evrgreen Lead Alert: New hot lead for Example Home Services. Jordan, water heater leak, zip 55416, wants service this week. Reply STOP to opt out."

Terms for both programs

• Message frequency varies. Inquiry Updates depend on your conversation with us; Lead Alerts send one message per new lead.
• Message and data rates may apply.
• To opt out, reply STOP at any time. You'll receive one confirmation message and no further texts from that program.
• For help, reply HELP or email hello@evrgreendigital.com.
• Consent to receive texts is not a condition of any purchase.
• Carriers are not liable for delayed or undelivered messages.

Messages sent on behalf of our clients

Businesses that use an Evrgreen system may text their own leads and customers. Those messages are sent in that business's name, only to people who opted in with that business, and are governed by that business's own terms and privacy policy, not these terms. To stop them, reply STOP to the message or contact the business directly.

No guaranteed results

Descriptions on this site of what our services do reflect how they're designed and our honest intent. They are not a guarantee of any specific result for your business, such as a particular number of leads, bookings, or revenue. Actual outcomes depend on your business, your market, your traffic, how quickly your team follows up, and how a system is configured. Any commitments about performance appear only in a written service agreement.

AI-generated responses

Evrgreen systems use AI to generate responses from information a business provides. While we design them to answer only from approved information and to hand off to a person when unsure, AI responses can occasionally be incomplete or inaccurate. Important details such as pricing, availability, and appointments should be confirmed with the business directly.

Intellectual property

The content, design, copy, and branding on this site belong to EVRGREEN. You're welcome to link to it or reference it; you may not copy or republish it as your own. Ownership of work product created for a client is set out in that client's service agreement.

Third-party services

This site and our systems rely on third-party providers, such as hosting, messaging, and AI providers. We aren't responsible for their availability or practices, though we choose them with care.

No warranty

This site is provided "as is" and "as available." We work to keep it accurate and available, but we don't warrant that it's error-free, complete, or uninterrupted.

Limitation of liability

To the fullest extent permitted by law, Evrgreen and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of this site or our text messages. Our total liability for any claim related to this site will not exceed one hundred U.S. dollars ($100). This section doesn't limit any separate liability terms in a written service agreement.

Governing law

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Minnesota.

Changes

We may update these terms from time to time. If they change in a meaningful way, we'll update the date at the top of this page. Continuing to use the site after that means you accept the updated terms.
